Car Impounded

There are many sections under the California Vehicle Code that give peace officers the discretion to tow and impound your car.  Below is a list of moving violations that commonly result in your car being towed and impounded in San Diego

California Vehicle Code Section 22651(p)  

This section allows an officer to tow and impound a vehicle where the operator of the vehicle has been cited for any of the following offenses:

            1. Reckless Driving,

            2. Driving under the Influence,

            3. Driving on a Suspended License,

            4. Habitual Traffic Offender

            5. Driving Without a California Drivers License or when the license is expired.

I am particularly interested to hear about your case if you have been pulled over  for an expired license or failure to show proof of license pursuant to California Vehicle Code Section 12500 and your car was towed.  I believe this section may be unconstitutional and your civil rights may have been violated.   If you fall into this category I strongly urge you to contact me as soon as possible to discuss your case.

California Vehicle Code Section 22651(o)(1) - Expired or No Registration

This section allows a peace officer to tow and impound a car they have pulled over or found on the highway where a car is not properly registered in the state of California or where the registration has been expired for more than six months.

California Vehicle Code Section 22651.6 - Engaging in a Speed Contest or Unlawful Exhibition of Speed

This section allows a peace officer to tow an impound a vehicle where the operator of the vehicle has been cited, arrested AND taken into custody for engaging in a speed contest as described in section 23109 of the California Vehicle Code.  However, some police officers make the mistake of simply citing the individual for engaging in a speed contest or exhibiting speed and then tow their car without taking them into custody.  If this has happened to you I strongly urge you to contact me.
